北京益仁平中心强烈谴责海尔集团的就业歧视行为

2008年8月,应届大学毕业生王先生来到海尔集团求职,海尔集团非法地在招聘体检中检测了乙肝病毒标志物项目。虽然王先生肝功正常,海尔还是以其是乙肝携带者为由拒录王先生。

益仁平中心强烈谴责这一违背企业社会责任、违背人类基本道德、违现行法律法规的严重侵犯公民平等就业权的行为!

中国卫生部2006年9月2日发布文件指出:"乙肝病毒携带者在生活、工作、学习和社会活动中不对周围人群和环境构成威胁,可以正常学习、就业和生活。"国家法律法规已经明确规定企事业单位入职体检不得检测乙肝项目,保护乙肝携带者的就业权利,《就业促进法》明确规定:用人单位招用人员,不得以是传染病病原携带者为由拒绝录用。

2009年1月,王先生向青岛市崂山区法院递交了民事起诉书,将海尔集团公司和青岛海尔洗衣机有限公司一起告上法庭。2009年2月26日,崂山区人民法院受理此案。该案立案后受到多家国家级和地方级媒体的广泛关注,并作出了相关报道。

我们很遗憾的看到,本案的审理过程遇到来自海尔和法院的阻力。2009年5月12日,法院审理本案时,竟然以不公开方式闭门审理;在审理过程中,海尔代理人态度傲慢地拒绝调解程序,并呵斥原告不许向媒体陈述受歧视的遭遇。

近日,我们获悉,此案将于6月23日再次审理,法院仍然决定采取不公开的方式闭门审理。

北京益仁平中心是一家致力于反歧视工作的公益机构,倡导"公益、仁爱、平等",反对针对乙肝携带者、艾滋病病毒感染者及其他健康弱势人群的任何歧视行为。我们强烈谴责海尔集团违法拒录乙肝携带者的行为,强烈谴责青岛市崂山区法院阻挠本案公开审理的行为。

我们呼吁各界关注该起侵犯公民基本就业权利的事件,支持王先生的依法维权行为,共同促使海尔集团纠正其违法行为,并采取措施挽回为其对王先生所造成的伤害,尽一个企业应尽的社会责任。

In August 2008, Mr. Wang, a graduating student applied to Haier, China's star electronics maker, for a job. In the recruiting process, Haier mandated physical examinations that include Hepatitis B Virus marker, which is illegal in China. For the reason that Mr. Wang was a HBV carrier, Haier further declined Mr. Wang's eligibility despite the fact the exams show that his liver function was fine, which violated Chinese law once again.
 
We strongly condemn the practices by Haier that violates equal employment rights, which acted against laws, cooperative social responsibility and morality.
 
China's Ministry of Health issued guidelines on September 2, 2006 that said HBV carriers, in their living, work, study and social contacts, do not pose a threat to people around them and therefore shall study, work and live normally. World Health Organization explained "HBV is not spread by contaminated food or water, and cannot be spread casually in the workplace." In another regulation jointly published by the Ministry of Health and Ministry of Labour and Social Security, China banned mandatory check-up for HBV marker to protect the carriers' rights to employment. Also, the Employment Promotion Law stipulates that "No employment unit, when recruiting employees, shall refuse to employ a job candidate on the basis that he/she is a carrier of any infectious pathogen".
 
Mr. Wang later filed a civil lawsuit against Haier and one of its Qingdao subsidiaries in January 2009 at Laoshan District of the city of Qingdao,which accepted to hear the case, leading to a number of media reports on the issue.
 
Regrettably, however, we see Haier and the district court contaminating the due process with hurdles and resistance. The court abnormally conducted the hearing behind closed doors on May 12 and in the courtroom, representatives of the defendant Haier, arrogantly rejected any mediation efforts and scolded and warned the plaintiff not to talk to the media about the discrimination he suffered.
 
Recently, we have got the word that the court would once again try the case behind closed doors, with the date set at June 23.
Beijing YIRENPING Center is a non-profit organization dedicated to promote public interest and focused its efforts in combating discrimination against HIV/AIDS patients, HBV carriers and other other disadvantaged groups in health. We strongly condemn Haier's illegal discrimination against HBV carriers and Laoshan District Court, which has taken extraordinarily abnormal efforts to shut this case down to the general public.
 
Here we are calling people from all walks of life to pay attention to this case, in which China's top and prominent enterprise, Haier, violates the citizen's rights to equal employment, and support Mr. Wang, one of the estimated 130 million HBV carriers in the entire China, to fight for his rights by legal means. Together we shall urge Haier to correct its illegal policies, make proper compensations to the damage done to Mr. Wang and fulfill its own social responsibility.
